香港商標注冊申請條件：

中國國內(nèi)可以用個人或法人申請；自然人注冊需提交個人身份證或護照復印件，法人則需要營業(yè)執(zhí)照副本復印件。

辦理香港商標注冊申請所需材料：

以法人申請，附《營業(yè)執(zhí)照》或有效登記證明復印件1份和公司名稱地址中英文相對應(yīng)的翻譯；以自然人申請附個人身份證復印件1份；

清晰商標圖樣1份；

填寫申請表1份，申請表必須由申請人簽署或由代理人簽署;

列出尋求注冊的商品或者服務(wù)，指出商標類別（香港的商標可以全類保護），可從本網(wǎng)站，商標分類表中查詢。

商標注冊委托書，申請人必須在該委托書上簽字蓋章

香港商標注冊公司查詢：

任何人都可隨時使用香港政府知識產(chǎn)權(quán)署的免費搜索網(wǎng)頁。搜索是否有相同或相似的注冊香港商標和在先申請。

如果要委托本公司全面地和專業(yè)地搜索，則每搜索1商標在1個國際分類的收費是人民幣500元。 所需時間是1個工作日。搜索報告是以書面作出, 內(nèi)容包括確實在香港有無相同的注冊商標和在先申請, 列出所搜索出的近似的商標, 并提供對近似商標是否構(gòu)成，混淆相似，作出本所的專業(yè)書面意見。

如果客戶所要申請的商標有文字也有圖案，本公司的搜索將無加費地包括那文字和圖案兩部份。若是本公司書面意見作出正面的申請建議，而申請后出現(xiàn)審批員因有混淆相似的商標存在而作出的反對, 本公司將退還所有的申請收費。

商標注冊處在審查有關(guān)申請前，會先詳細檢視申請表格及所有附件，以查看表格內(nèi)須填寫的部分是否已經(jīng)填妥、有關(guān)資料是否正確、所需資料是否不全。如一切妥當，申請程序會進入下一階段（實質(zhì)審查階段）。

香港商標注冊實質(zhì)審查：

完成檢查申請的不足之處并確定所有資料備妥后，商標注冊處會翻查商標記錄，以確定在相同或類似的貨品或服務(wù)，是否有其他商戶已經(jīng)注冊或申請注冊相同或類似的商標。商標注冊處會同時查核有關(guān)商標是否符合《商標條例》所訂的注冊規(guī)定。

如審核通過，申請程序?qū)⑦M入下一階段（登憲公告階段）。登記登記公告：

商標注冊處核準申請后，便會在香港知識產(chǎn)權(quán)公報公告，為期三個月，如無人提出異議，該商標就可以成功注冊了。

注冊：

商標注冊申請被核準后，便會把該商標的詳細資料記入注冊紀錄冊，并向申請人發(fā)出注冊證明書。此外，商標注冊處處長會在香港知識產(chǎn)權(quán)公報中公布有關(guān)的注冊公告。注冊日期會追溯至提交申請當日，換言之，作為注冊商標擁有人的權(quán)利，應(yīng)由提交申請當日起計。

申請商標費用：

申請商標的收費為第一個國際分類為￥2380。 每加入一個分類需另外加收￥1800。付予香港政府的申請費以及查冊費都已包括在內(nèi)，公告、注冊和領(lǐng)證都無另收費。除非申請受到審批員的反對，需要作出修改，遭受異議或者出現(xiàn)其它復雜情況，否則無其它的收費。

注冊香港商標辦理時間：

提供注冊商標之圖案及類別，進行初步查冊；

填寫商標注冊申請書，提交商標注冊的正式圖樣及商標申請者資料；

正式進入商標注冊流程（約4——6個月）：

政府查冊（一周）——香港知識產(chǎn)權(quán)署商標受理之回執(zhí)（2周）——政府內(nèi)部審核——排版印刷——憲報公告（3個月）——正式審批完成——領(lǐng)取商標證書。（有效期限10年，可續(xù)期）

香港商標注冊辦理流程：

1、向香港知識產(chǎn)權(quán)署提出申請；

3、審查；

4、刊登公告，三個月的異議期；若被提異議（香港稱為反對），申請人須對此作出答辯（香港稱為反陳述），否則申請將被撤回；

5、核準注冊，領(lǐng)取商標注冊證。

注意事項

注冊香港商標的保護措施

注冊香港商標的有效期為7年，之后可續(xù)期14年，續(xù)展次數(shù)不限，香港商標注冊有效期以申請日開始計算。在A部或在B部注冊的商標法律地位有所不同。在A部注冊的商標專用權(quán)有較大保障。A部的注冊商標注冊期滿7年或視為永久有效；在 B部注冊的商標則不享有相同的法律保障，在注冊期滿后，其注冊效力仍可能受到質(zhì)疑。在遇到商標侵權(quán)時，法院易于作出對A部注冊商標侵權(quán)的認定，而對B部注冊的商標所有人的指控，被告人可有較多的辯護理由，法院也可能不予頒發(fā)禁止令。

商標設(shè)計要注意以下問題

獨創(chuàng)性，即商標的設(shè)計要有新意;商標的名稱應(yīng)避免與商品的功能聯(lián)在一起;商標的設(shè)計要突出主題，合理布局。

香港商標注冊注意事項

注意事項:

1、為了使該商標能順利注冊成功，首先考慮該商標是否具顯著特性，最好自己設(shè)計與眾不同的文字及圖形創(chuàng)新的商標。

2、不可抄襲別人或跟別人類似的商標到頭來浪費自己的時間和金錢.

3、注冊此商標前有否在其他國家己注冊，如有請?zhí)峁└北?，半年之?nèi)有優(yōu)先權(quán)。

商標維權(quán)

在香港，任何人均可對公告的商標申請?zhí)岢龇磳Α７磳θ隧氃谏虡斯贾掌?個月內(nèi)提交反對通知，并在指定時限內(nèi)提供證據(jù)。如反對人在商標注冊處安排的聆訊中敗訴，或需支付另一方訟費。

注冊商標的擁有人可就該商標遭侵犯而進行訴訟。在反侵犯法律程序中，注冊商標的擁有人可獲得所有屬損害賠償、強制令、交出所得利潤形式或其他形式的濟助。
